Notice to users: Carefully read the following terms and conditions ("the Agreement") which governs the use by you ("the User") of the Goireland.com service.
GoIreland.com service.
The GoIreland.com service ("the Service") is an online tourism information and accommodation reservation service that also provides the User with the facility to access third party websites which detail offers of transport, events, packaged tours etc. The Service is operated and managed by Gulliver InfoRes Services Ltd, Killorglin, County Kerry, Ireland (“Gulliver Ireland”).
This Agreement represents the entire agreement between the parties relating to the Service and supersedes any and all prior promises, representations, agreements, statements and understandings whatsoever which existed or may have existed between Gulliver Ireland and the User. Gulliver Ireland may modify the Agreement upon notice published over the Service. Gulliver Ireland reserves the right to suspend, modify or amend the Service (or any part thereof) from time to time.
Gulliver Ireland grants to the User a personal, non-exclusive, non-transferable licence ("the Licence") to access and use the Service under the terms of this Agreement. The User shall not assign, dispose of, sub-license or otherwise transfer its rights granted by this Agreement and in particular the User shall not allow any person to use the Service. The Service shall not be used by any User for multi, group or business purposes. Intellectual Property Rights
The User acknowledges that the copyright, trade marks and all other intellectual property rights in or relating to the Service are and shall remain the property of Gulliver Ireland or it’s suppliers.
The User shall not copy, market, re-sell, distribute, retransmit, publish or otherwise transfer or commercially exploit in any form the Service.
Except to the extent permitted by law, the User shall not reverse engineer, decompile, disassemble, alter or modify the whole or any part of any software which is accessible via or in connection with the Service. The User shall not access the Service by any means, or in any sequence, other than those provided on-line as part of its normal user interface.
The User will not use or display the name or logo of Gulliver Ireland or it’s domain name goireland.com or any similar name or logo or act in any way that would imply that the User is an agent of Gulliver Ireland.
Liability
Gulliver Ireland does not guarantee, represent or warrant the accuracy, completeness, currency, reliability or usefulness of any information provided as part of the Service.
Clicking on certain links within this site might take the User to other third party sites and Gulliver Ireland shall have no responsibility or liability of any kind for the accuracy or content of any information or any other aspect of any such third party sites.
Gulliver Ireland shall under no circumstances be liable to the User in respect of any claim by the User for indirect or consequential loss or damage (including loss of profits or goodwill) whether or not caused through negligence, relating to the Service or other information provided as part of the Service, or its use by the User. Gulliver Ireland shall not be liable and shall not otherwise be deemed to be in breach of this Agreement, for any failure to perform (or delay in performing) any of its obligations hereunder caused by circumstances beyond its reasonable control.
Termination
Without prejudice to any other rights or remedies, Gulliver Ireland may at any time suspend the Service or terminate the Licence forthwith if the User is in material breach of any of its obligations under the Agreement.
Governing Law and Disputes
This Agreement shall be governed by and construed in accordance with the laws of Ireland (excluding laws governing the conflict of laws) and the parties submit to the jurisdiction of the Irish Courts. This will not prevent Gulliver Ireland from pursuing a claim for breach of contract, copyright infringement or otherwise in respect of this Agreement or the Service in any other jurisdiction.
